A BILL to amend article seven, chapter forty-nine of the code of
West Virginia, one thousand nine hundred thirty-one, as
amended, by adding thereto a new section, designated section
thirty-three, relating to procedures required for payment for
services rendered by medical professional when submitting them
to the West Virginia department of health and human resources.
Be it enacted by the Legislature of West Virginia:

That article seven, chapter forty-nine of the code of West
Virginia, one thousand nine hundred thirty-one, as amended be
amended by adding thereto a new section, designated section thirty-
three, to read as follows:
ARTICLE 7. GENERAL PROVISIONS.
§49-7-33. Payment of services.

At anytime during any proceedings conducted under articles
five and six of this chapter, the court may upon its own motion, or
upon its order, or upon a motion of the other parties, order the West Virginia department of health and human resources to pay for
the services rendered by a psychologist, psychiatrist, medical
physician, therapist or other medical professional to any child or
any other party to these proceedings. Services include but are not
limited to treatment, therapy, counseling, evaluation, report
writing, consultation and preparation in anticipation of testimony.
The West Virginia department of health and human resources shall
set and adjust the fee schedule for such services. Every such
physician, psychologist, psychiatrist, medical physician, therapist
or other medical professional shall be paid by the West Virginia
department of health and human resources once services are
completed and proper information and documentation are submitted in
accordance with the policies and procedures implemented by the West
Virginia department of health and human resources.

NOTE: The purpose of this bill would require the West
Virginia department of health and human resources to pay for
professional services in accordance with an established fee
schedule set by the department.
